Re:  Bingo and Raffle Operation

 

Dear Licensee:

 

As you are aware, Senate Bill 370 made a number of changes to the Bingo and Raffle Act that has left many of you unsure of how to proceed with your current bingo and raffle operations.  The Gaming Control Board is currently looking at making some changes to the rules that will impact your operation; however, we intend on doing so after looking at your current bingo and raffle operation.  Therefore, you will continue with your current operating practice and abide by the current rules in place.  As far as expenses are concerned, you will utilize the rates that were outlined in the Bingo and Raffle Act prior to Senate Bill 370. 

 

Several individuals have asked how our agency will handle hybrid games.  Our agency will require licensees to continue with the practice that has been established by the Regulations & Licensing Department regarding hybrid games.  Enclosed with this letter is a memorandum to the licensees regarding hybrid games from Regulations and Licensing dated August 17, 2004.  This memorandum clearly indicates that hybrid games must be reported with the $1500.00 payout limit set out in section 60-2B-8(J) NMSA.

 

The only immediate change that has occurred and must be followed is the submission of the 3% tax.  All taxes must be submitted to the Taxation and Revenue Department on the bingo and raffle tax form by the 25th of each month. 

 

We are aware that there have been a number of discussions about new forms and rules by several licensees.  We would like to state again, there have been no decisions made at this time on what forms or what rules will be changed. You will be notified prior to any changes to the rules or forms before they become effective. We welcome any comments that you may have regarding any changes contemplated by our agency.
